Australia's financial regulator is cracking down on deceptive and misleading initial coin offerings (ICOs), which it says are "serious breaches of Australian law". As regulators investigate this, many ICO issuers have suspended their token offerings or modified their offering structures.
ASIC takes action on ICO activity
The Australian Securities and Investments Commission (ASIC) announced on Tuesday that it was taking action against "misleading or deceptive practices in the promotion and sale of digital or virtual tokens through initial coin offerings (ICOs)."
ASIC is an independent Australian government agency and acts as the country's corporate regulator. "These offerings may present significant risks to investors who have not been adequately disclosed or are not fully aware of the risks involved," ASIC noted. The committee wrote:
“If we find conduct or statements that may be misleading or deceptive, we will investigate ICO issuers and their advisors. In addition, we will investigate unlicensed business practices. Therefore, some ICO issuers have either stopped their ICO activities or made it clear that they will modify their ICO structure.”
ASIC is authorized by ACCC to supervise
The Australian Competition and Consumer Commission (ACCC) on April 19 authorized ASIC to take action against crypto-assets-related activities under the Australian Consumer Law. "The ACCC authorizes ASIC to take action against misleading or deceptive conduct in the marketing or sale of ICOs, whether or not ICOs involve financial products," ASIC said.
ASIC Commissioner John Price detailed:
